My father has been in the VA hospital since last year.

Last night his surgeon told us plainly that he has less than a week to live.

Long story short, he is at this point due to negligence and in-action from the surgical team and hospital in general

Does anyone know of a good FTCA Lawyer that is in the area? One willing to take the case against the VA, and for payment after winning?

Anyone know what needs to be done to prove negligence? How do we get the medical examiner involved? A big part of my families problem right now is we dont know what we are doing as we've never lost anyone in our imediate family...

You have my empathy on your situation. We filed a Wrongful Death suit when my mother was killed. Due to charges not being filed it was relegated to a civil suit and due to defendants bankruptcy, the case was dropped. It will be very hard for you to find a good enough lawyer to take on the VA. Their reputation isn't a gold star one and I'm sure many have tried. I don't know of any lawyers off hand, but contact some of the lawyer associations to point you in the right direction. You might be able to get some info from your local court clerks on who is licensed to represent a malpractice suit. It is a tough time for you and your family and make sure that you all are prepared for the burdens, the possible highs and lows of filing suit as it will be a long process. Good luck and God bless.

I'm an attorney at a firm in Fairfax. I don't think anyone here practices the kind of law you're looking for, but I sent an e-mail out to some of my colleagues to see if there's someone I can refer you to. I'll send you a PM if I hear anything.
